ha emanato la Circolare n. 4 del 2024, che introduce e fornisce le prime indicazioni operative in merito alla \"Patente a Crediti\", un nuovo strumento obbligatorio per le imprese e i lavoratori autonomi che operano nei cantieri temporanei o mobili.<br><br><i><u>La patente entrer\u00e0 in vigore dal 1\u00b0 ottobre 2024<\/u><\/i><\/h2>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-6cb26979 elementor-widget-divider--view-line elementor-invisible elementor-widget elementor-widget-divider\" data-id=\"6cb26979\" data-element_type=\"widget\" data-settings=\"{&quot;_animation&quot;:&quot;fadeIn&quot;}\" data-widget_type=\"divider.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<h5 style=\"font-style: normal;\">Soggetti obbligati<\/h5>\n<p><span style=\"background-color: var(--ast-global-color-5);\"><u>Come previsto dal Decreto Legislativo n. 81\/2008 e dal Decreto Ministeriale del 18 settembre 2024 n. 132.<\/u><\/span><u style=\"font-style: inherit; font-weight: inherit; background-color: var(--ast-global-color-5);\">al 1\u00b0 ottobre 2024, saranno tenuti al possesso della Patente a Crediti:<\/u><\/p>\n<ul>\n<li>Imprese (anche non edili) che operano fisicamente nei cantieri temporanei o mobili.<\/li>\n<li><span style=\"font-style: inherit; font-weight: inherit; background-color: var(--ast-global-color-5);\">Lavoratori autonomi che operano nei cantieri.<\/span><\/li>\n<li><span style=\"font-style: inherit; font-weight: inherit; background-color: var(--ast-global-color-5);\">Imprese e lavoratori autonomi stabiliti in Stati membri dell&#8217;UE o in paesi extra UE, salvo possesso di documentazione equivalente.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-style: inherit; font-weight: inherit; background-color: var(--ast-global-color-5);\">&nbsp;<\/span><\/p>\n<h5 style=\"font-style: normal;\">Soggetti esonerati<\/h5>\n<ul>\n<li><span style=\"background-color: var(--ast-global-color-5); font-style: inherit; font-weight: inherit;\">Le imprese che effettuano mere forniture o prestazioni di natura intellettuale (come ingegneri, architetti e geometri).<\/span><\/li>\n<li><span style=\"font-style: inherit; font-weight: inherit; background-color: var(--ast-global-color-5);\">Le imprese in possesso di attestazione di qualificazione SOA con una classificazione pari o superiore alla III, indipendentemente dalla categoria.<\/span><\/li>\n<\/ul>\n<p><span style=\"background-color: var(--ast-global-color-5); font-style: inherit; font-weight: inherit;\">&nbsp;<\/span><\/p>\n<h5 style=\"font-style: normal;\">Requisiti per il rilascio della patente<\/h5>\n<ul>\n<li>Iscrizione alla Camera di Commercio.<\/li>\n<li>Regolarit\u00e0 contributiva e fiscale (DURC e certificazione fiscale).<\/li>\n<li>Adempimento degli obblighi formativi previsti per la sicurezza sul lavoro (D.lgs. n. 81\/2008).<\/li>\n<li>Documentazione di valutazione dei rischi (ove applicabile).<\/li>\n<li>Designazione del responsabile del servizio di prevenzione e protezione (nei casi previsti).<\/li>\n<\/ul>\n<p><i><u>Modalit\u00e0 di richiesta:<\/u>&nbsp;<span style=\"font-weight: inherit; background-color: var(--ast-global-color-5);\">a partire dal 1\u00b0 ottobre 2024, le imprese e i lavoratori autonomi potranno richiedere la patente accedendo al portale digitale dell&#8217;Ispettorato del Lavoro tramite credenziali SPID o CIE. La richiesta pu\u00f2 essere presentata direttamente o tramite un delegato (es. consulente del lavoro o commercialista).<br><\/span><span style=\"background-color: var(--ast-global-color-5);\"><b>Saranno fornite ulteriori istruzioni tecniche con nota successiva.<br><br><\/b><\/span><\/i><\/p>\n<p><\/p>\n<h5 style=\"font-style: normal;\">Informazioni aggiuntive<\/h5>\n<p><span style=\"font-weight: bold;\">Punteggio e crediti<br><\/span><span style=\"background-color: var(--ast-global-color-5); font-weight: var( --e-global-typography-text-font-weight ); font-style: inherit;\">Ogni patente \u00e8 inizialmente dotata di 30 crediti, che possono aumentare fino a un massimo di 100 in base a vari parametri, come l\u2019anzianit\u00e0 dell\u2019impresa e l\u2019assenza di violazioni.<\/span><\/p>\n<p><span style=\"font-weight: bold;\">Sanzioni e revoca<\/span><br>In caso di dichiarazioni false o mancanza dei requisiti, la patente pu\u00f2 essere revocata. Le imprese che operano senza la patente o con meno di 15 crediti non potranno continuare a lavorare nei cantieri, e saranno soggette a sanzioni fino a 10% del valore dei lavori affidati.<\/p>\n<h5 style=\"font-style: normal;\"><span style=\"font-style: inherit; font-weight: inherit; background-color: var(--ast-global-color-5);\"><br>Autocertificazione<\/span><\/h5>\n<h5 style=\"font-style: normal;\"><span style=\"font-size: 15px; font-style: inherit; color: #505050; background-color: var(--ast-global-color-5); font-weight: normal;\">\u00c8 possibile presentare un\u2019autocertificazione temporanea concernente il possesso dei requisiti richiesti fino al 31 ottobre 2024.<\/span> <b style=\"font-size: 15px; font-style: inherit; color: #505050; background-color: var(--ast-global-color-5);\"><u>Tale autocertificazione dovr\u00e0 essere inviata tramite PEC all\u2019indirizzo dichiarazionepatente@pec.ispettorato.gov.it.<\/u><\/b> <span style=\"font-size: 15px; font-style: inherit; color: #505050; background-color: var(--ast-global-color-5); font-weight: normal;\">\u00c8 possibile utilizzare il modello di autocertificazione fornito nella circolare, disponibile in allegato. Dopo tale data, sar\u00e0 obbligatorio formalizzare la richiesta di rilascio della patente attraverso il portale INL per continuare a operare nei cantieri.<\/span><\/h5>\n<p><span style=\"font-size:
